1. Agreement to These Terms

Welcome to artisanathudson.com. These Terms & Conditions ("Terms") govern your use of this website and any other website, microsite, landing page, community site, online form, chat feature, or digital service that links to these Terms (together, the "Site"), all of which are operated by Solera Senior Living, LLC and its affiliated and managed communities ("Solera," "we," "us," or "our").

By accessing or using the Site — including browsing it, submitting a form, using our chat feature, calling a number listed on the Site, or opting in to receive communications from us — or manifesting your assent to these Terms in any other way, you agree to these Terms.

If you do not agree to these Terms, please do not use the Site.

THESE TERMS CONTAIN IMPORTANT PROVISIONS IN SECTIONS 15–18, INCLUDING DISCLAIMERS OF WARRANTIES, LIMITATIONS OF LIABILITY, INDEMNIFICATION OBLIGATIONS, AN EXCLUSIVE FORUM PROVISION, A CLASS ACTION WAIVER, AND A REQUIREMENT THAT CLAIMS BE BROUGHT WITHIN ONE YEAR. PLEASE READ THEM CAREFULLY.

2. Who May Use the Site

The Site is intended for adults 18 and older who are located in the United States. It is not directed to children, and we do not knowingly collect personal information from anyone under 13. If you believe a child has provided us personal information, please contact us at the address in Section 23 and we will delete it.

The Site is operated from the United States. We make no representation that its content is appropriate or available in other locations, and you are responsible for complying with local law if you access it from outside the U.S.

3. Informational Purpose Only — No Medical Advice

The Site describes our communities, lifestyle and care options, amenities, events, and resources. It is provided for general informational and educational purposes only.

The Site does not provide medical, nursing, clinical, legal, financial, tax, insurance, or professional advice, and nothing on it should be treated as a diagnosis, treatment recommendation, or care plan for any individual. Articles, blog posts, checklists, quizzes, assessment tools, cost calculators, and similar resources are general in nature and do not account for any person's specific circumstances.

Always consult a qualified physician or other licensed professional about a medical condition, and a qualified attorney or financial advisor about legal or financial decisions. Never disregard or delay seeking professional advice because of something you read on the Site.

IF YOU OR SOMEONE ELSE IS EXPERIENCING A MEDICAL EMERGENCY, CALL 911 OR YOUR LOCAL EMERGENCY NUMBER IMMEDIATELY. DO NOT USE THIS SITE, OUR FORMS, OR OUR CHAT FEATURE TO REPORT AN EMERGENCY OR AN URGENT CARE CONCERN.

To reach a resident or a community team directly, please call that community's phone number listed on its page.

4. No Offer; Residency Is Governed by the Residency Agreement

Information on the Site about availability, floor plans, apartment sizes, pricing, care levels, services, amenities, programming, or move-in incentives is provided for general reference, may change without notice, and is not an offer, a reservation, a guarantee of availability, or a quote.

Care levels, services, and pricing are determined individually following an assessment, vary by community and by state licensure, and are not available at every community.

Your rights and obligations as a resident — and ours — are set out solely in the signed Residency Agreement (and any related care or service agreements) for the applicable community. In the event of any conflict between the Site and a signed Residency Agreement, the Residency Agreement controls. Nothing on the Site creates a residency, care, or service relationship. Submitting an inquiry, requesting information, joining a waitlist, requesting or scheduling a tour, completing an online assessment or questionnaire, communicating through chat, or otherwise interacting with the Site does not guarantee that Solera or any community will respond within a particular period, schedule or complete a tour, reserve or hold an apartment, accept any person for residency, offer any particular apartment, service, care level, rate, incentive, or move-in date, or determine that a community is appropriate for any person. Admission, residency, care-level, and service determinations are subject to applicable law, community availability, required assessments, community policies, licensure and staffing requirements, and execution of the applicable Residency Agreement and related documents.

Photographs, floor plans, virtual tours, and renderings may be artists' representations, stock imagery, or images of other Solera communities, and may not depict a specific available apartment or a community's current condition. Communities identified as "in development" or "coming soon" are subject to change, delay, or cancellation.

5. Do Not Submit Health Information Through the Site

Please do not submit health information, medical records, diagnoses, medication lists, financial account numbers, Social Security numbers, or other sensitive information through our website forms, chat feature, or general email.

The Site is a marketing and information channel, not a secure clinical portal, and information you submit through it is not covered by HIPAA. If you need to share health or financial details, please speak with a community team member directly by phone or in person so we can use a secure channel.

6. Information You Submit; Authority and Accuracy

When you submit information through the Site, including through a form, chat, tour request, or other inquiry, you represent and warrant that:

  • The information is truthful, accurate, current, complete, and not misleading to the best of your knowledge;

  • You are submitting the information for a lawful purpose and have the right to provide it to us;

  • If the information concerns another person, you are that person’s legal guardian, personal representative, authorized caregiver, or other authorized representative, or you otherwise have that person’s permission and all authority, consents, and legal rights necessary to submit the information and permit Solera and its service providers to use it as described in these Terms and our Privacy Policy; and

  • You are not impersonating another person or misrepresenting your identity, authority, relationship to another person, or the circumstances described in your submission.

You agree to promptly correct or update any information you have provided if you learn that it is inaccurate, incomplete, or misleading.

Nothing in this section permits you to submit protected health information, financial account information, Social Security numbers, medical records, or other sensitive information through a channel that Section 5 states should not be used for that purpose.

7. How We May Treat the Information You Provide

When you provide information through the Site, you direct and authorize Solera, its affiliates, managed communities, community owners and operators, and their respective service providers to collect, receive, access, maintain, store, organize, use, transmit, disclose, and otherwise process that information, subject to applicable law and our Privacy Policy, for purposes including:

  • Responding to your inquiries;

  • Identifying and routing your inquiries to a Solera community or team member;

  • Providing information you request;

  • Scheduling, confirming, and following up on tours, appointments, or other requested interactions;

  • Maintaining records of your communications;

  • Operating, administering, supporting, troubleshooting, securing, and improving the Site and its forms, chat features, communications tools, and related systems;

  • Detecting, investigating, preventing, and responding to fraud, misuse, security incidents, unlawful activity, or violations of these Terms;

  • Complying with applicable law, legal process, regulatory requirements, and record-retention obligations; and

  • Protecting the rights, property, safety, and security of Solera, its communities, residents, prospective residents, personnel, service providers, and others.

Solera may use third parties to provide hosting, customer-relationship management, communications, call-tracking, chat, analytics, scheduling, security, storage, and other services in connection with these purposes. Those service providers may process information on Solera’s behalf and subject to applicable contractual and legal requirements.

Submitting information through the Site does not require Solera or any community to accept a prospective resident, provide services, reserve a unit, determine that a particular community or level of care is appropriate, or take any particular action.

8. Communications With Artisan at Hudson

When you submit a form, request information, schedule a tour, download materials, subscribe to updates, use our chat feature, or otherwise contact us, you agree that we and our communities may contact you by phone, email, and text about your inquiry, our communities and services, availability, events, and related information.

We may also send you marketing communications where you have separately consented to receive them or where otherwise permitted by applicable law. Consent to receive marketing calls or text messages is not a condition of obtaining information, touring a community, applying for residency, or becoming a resident. Marketing text messages are also governed by the SMS Terms below.

Third-party referral sources. If you reached us through a third-party referral service, senior-living marketplace, or advertising partner, that company's own terms and privacy policy govern the information you gave them. We are not responsible for their practices.

Call recording and call tracking. Calls to and from our communities and our sales line may be monitored or recorded for quality assurance, training, and marketing-attribution purposes. We also use call-tracking technology that may associate a phone call with your visit to the Site. Where required by law, you will hear a notice at the start of the call; if you do not wish to be recorded, please tell the team member and they will stop the recording or continue by another method.

Chat and virtual assistants. Some pages offer a chat feature that may be powered wholly or partly by automated technology, including artificial intelligence, rather than a live person. Automated responses may be inaccurate or incomplete and should not be relied on as advice of any kind. Chat transcripts may be stored and reviewed by us or our third-party provider(s). Do not enter sensitive or health information into chat.

9. Text (SMS) Messaging Terms

These SMS Terms apply if you opt in to receive text messages from Solera Senior Living or one of our communities.

  1. Program description: By providing your mobile number and opting in, you consent to receive text messages from Solera regarding your inquiry, tour scheduling and reminders, availability, community news and events, resident and family updates, and related marketing messages, which may be sent using an automatic telephone dialing system.

  2. Consent is not a condition of purchase: Your consent to receive marketing texts is not required to tour, to receive information, or to become a resident.

  3. Message frequency: Varies based on your interaction with us and the programs you have joined.

  4. Message and data rates may apply: Check your plan with your mobile carrier.

  5. Opting out: Reply STOP to any message to unsubscribe. You will receive one confirmation message and then no further texts from that program unless you opt in again.

  6. For Help: Reply HELP for assistance, or contact us at (978) 763-7111 or ArtisanLeasing@soleraseniorliving.com.

  7. Carriers are not liable for delayed or undelivered messages.

  8. Supported carriers may change without notice. T-Mobile is not liable for delayed or undelivered messages.

  9. Sharing limitations: We do not sell, rent, or share your mobile number or SMS consent with third parties or affiliates for their own marketing purposes. Any sharing is limited to service providers who help us deliver messages on our behalf.

10. Email Communications

If you give us your email address, we may send you responses to your inquiry, requested materials, newsletters, event invitations, resources, and community updates. You may unsubscribe from marketing email at any time using the link in any message or by contacting us at ArtisanLeasing@soleraseniorliving.com. We may still send you transactional or relationship messages (for example, a reply to a question you asked or information about a scheduled tour).

11. Acceptable Use

You agree to use the Site only for lawful, personal, non-commercial purposes, and you agree that you will not:

  • Interfere with or disrupt the Site, its security, or its accessibility, or attempt to gain unauthorized access to any system, account, or network connected to it;

  • Use any robot, spider, scraper, crawler, or other automated means to access, harvest, or compile content or data from the Site, except by a general-purpose search engine acting in accordance with our robots.txt;

  • Use content from the Site to develop, train, fine-tune, or evaluate any machine learning or artificial intelligence model, or to build any dataset or derivative product, without our prior written permission;

  • Submit false, misleading, or impersonating information, including submitting another person's contact information without their permission;

  • Upload or transmit malware, viruses, or other harmful code;

  • Use the Site to harass, defame, threaten, or violate the rights of any person, including our residents and team members;

  • Copy, republish, frame, mirror, sell, license, or commercially exploit any part of the Site;

  • Remove or obscure any copyright, trademark, or other proprietary notice;

  • Circumvent, disable, interfere with, or attempt to bypass any security, access-control, rate-limiting, consent, or other technical feature of the Site; or

  • Reverse engineer, decompile, disassemble, or attempt to derive any source code or non-public technology associated with the Site, or use the Site or its content to benchmark, develop, or improve a competing product, service, database, or technology, except to the extent such restriction is prohibited by applicable law.

We may investigate suspected violations of these Terms and take any action we reasonably determine appropriate, including restricting or blocking access to the Site, rejecting or removing submissions, preserving and disclosing information as permitted by law, referring matters to law enforcement or other authorities, and pursuing available legal or equitable remedies.

12. Intellectual Property

All content on the Site — including text, photographs, video, graphics, logos, icons, page design, and the overall selection, arrangement, and look and feel — is owned by or licensed to Solera and is protected by U.S. copyright, trademark, and other laws. © 202 Solera Senior Living, LLC. SOLERA and SOLERA SENIOR LIVING, together with our community names and logos, are trademarks of Solera Senior Living, LLC or its affiliates. Other names and marks appearing on the Site belong to their respective owners and are used for identification only; their appearance does not imply endorsement.

Subject to your compliance with these Terms, Solera grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to view, download, and print Site content solely for your own personal, non-commercial use, provided you keep all proprietary notices intact and do not modify the content. No other license or right is granted, expressly or by implication.

13. Third-Party Sites and Content

The Site may link to or embed third-party websites, tools, videos, maps, reviews, or services, including community-specific sites, career portals, payment portals, and resident or family portals. We provide these for convenience only. We do not control them, do not endorse them by linking to them, and are not responsible for their content, accuracy, availability, security, terms, or privacy practices. Review their terms and privacy policies before using them. Your dealings with any third party found through the Site are solely between you and that third party.

14. Accuracy, Availability, and Changes

We work to keep the Site accurate and current, but it may contain typographical errors, inaccuracies, or outdated information. We reserve the right to correct errors and to change, suspend, remove, or discontinue any part of the Site at any time, without notice and without liability. We do not guarantee that the Site will be uninterrupted, timely, secure, or error-free.

15. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT, TOOLS, AND FEATURES ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. SOLERA AND ITS SUPPLIERS AND LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, AND ACCURACY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SITE WILL MEET YOUR REQUIREMENTS, THAT ITS CONTENT IS COMPLETE OR CURRENT, OR THAT ANY DEFECTS WILL BE CORRECTED.

SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

Nothing in this section limits or disclaims any obligation Solera or a community owes a resident under a Residency Agreement or under applicable licensing, health, safety, or consumer-protection law.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SOLERA AND ITS AFFILIATES, MANAGED COMMUNITIES, OFFICERS, EMPLOYEES, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR, IF GREATER, THE MINIMUM AMOUNT THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.

SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

THESE LIMITATIONS DO NOT APPLY TO CLAIMS ARISING FROM RESIDENCY, CARE, OR SERVICES PROVIDED AT A SOLERA COMMUNITY, WHICH ARE GOVERNED BY THE APPLICABLE RESIDENCY AGREEMENT AND APPLICABLE LAW, AND DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING FOR PERSONAL INJURY CAUSED BY NEGLIGENCE, GROSS NEGLIGENCE, OR WILLFUL MISCONDUCT.

17. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Solera, its affiliates, managed communities, community owners and operators, and each of their respective officers, directors, employees, agents, contractors, and service providers from and against any claims, damages, liabilities, losses, costs, and reasonable attorneys’ fees arising out of or relating to:

  • Your violation of these Terms;

  • Your use or misuse of the Site;

  • Information or materials you submit through the Site;

  • Your violation of applicable law or any third-party right; or

  • Your failure to obtain any authority, permission, consent, or authorization required to submit information about another person.

18. Dispute Resolution and Governing Law

Informal resolution first. Before filing any claim, please contact us at ArtisanLeasing@soleraseniorliving.com and give us 30 days to try to resolve it informally.

Governing law. These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules, except where a state's consumer-protection or senior-care law provides you greater protection and cannot be waived.

Forum. Any dispute arising out of these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Denver County, Colorado, and you and Solera consent to personal jurisdiction and venue there.

Class Action Waiver. To the fullest extent permitted by applicable law, you and Solera agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, representative, or private attorney general action or proceeding arising out of or relating to these Terms, the Site, or your relationship with Solera. Unless both you and Solera agree otherwise in writing, any such claim must be brought solely on an individual basis and may not be asserted or maintained as part of any class, collective, consolidated, representative, or private attorney general action or proceeding.

Time limit. To the fullest extent permitted by applicable law, any claim, cause of action, dispute, or proceeding arising out of or relating to these Terms, the Site, or your relationship with Solera must be commenced within one (1) year after the claim or cause of action arose. Any claim not commenced within such period will be permanently barred, notwithstanding any longer statute of limitations that may otherwise apply under applicable law.

Consumer Rights. If you are a consumer, nothing in these Terms deprives you of the protection of mandatory provisions of the law where you reside or any non-waivable rights to which you are entitled under applicable law.

19. Fair Housing and Equal Opportunity

Solera Senior Living is an equal housing opportunity provider. We do not discriminate on the basis of race, color, religion, sex, familial status, national origin, disability, or any other characteristic protected by federal, state, or local law. Our communities are age-restricted housing operated in accordance with the Housing for Older Persons Act and applicable state law.

20. Accessibility

We are committed to making the Site usable by people of all abilities and are working toward conformance with WCAG 2.1 Level AA. 21. Changes to These Terms

We may update these Terms at any time by posting a revised version with a new "Last Updated" date. Material changes will be highlighted on this page for 30 days / emailed to subscribers. Your continued use of the Site after changes are posted means you accept the updated Terms. If you object to any change, your remedy is to stop using the Site.

22. General

If any provision of these Terms is found unenforceable, it will be limited or severed to the minimum extent necessary and the remainder will stay in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms are the entire agreement between you and Solera regarding the Site and supersede any prior understandings on that subject. Sections 3, 4, 5, 12, 16, 17, 18, and 19 survive any termination.
